Witnesses were called to take the stand on Monday this week regarding the late Chief Justice Patu Tiavasu'e Falefatu Sapolu's supposed will. Patu's dowager Iliganoa Daphne Sapolu is contesting the will and has performed charges against the Public Trustee's Office claiming that when the late Chief Justice passed away his will was tampered with or never existed.

Iliganoa Daphne Sapolu is one of the beneficiaries to the estate of the late Tiavasu'e supposed will that dates back to the 25th of September 2020. Mrs Sapolu is looking for evidence to prove that the submitted will is not the final will of the former and her late husband Tiavasu'e Falefatu Sapolu.

The widow stated that the alleged will on the 25th September 2020 was read out without the attendance of the other beneficiaries such as Katalaina , Patu's sister who was also one of the beneficiaries of the will. Mrs.Sapolu claims that the Public Trustee Office failed to re-evaluate if the will was interfered.

One of the witnesses that took the stand on Monday to support Iliganoa's claim, Sainimeri Naivila, a caretaker and housekeeper of the deceased Chief Justice was unsure and struggled to answer questions put forth by the Public Trustee's legal representative Tuatagaloa Shane Wulf.

Naivila is a key witness in this case and testified that she never saw the late C.J sign the will on the 25th of 2022.She claimed that she was forced to sign papers by Tiavasu'e's sister Katalaina Sapolu and Maka Komisi Sapolu, a nephew of Tiavasu'e who was also a beneficiary of the will.

According to the housekeeper this all happened inside a room when Tiavasu'e was hospitalized, and was asleep and wasn't aware at all that Mrs.Naivila was being forced to sign any papers.

Unasa Iuni Sapolu the lawyer that's representing Maka Sapolu the nephew of Tiavasu'e asked Mrs.Naivila in court on Monday about proof that Patu was hooked on to a dialysis machine which she mentioned in her sworn affidavit.

But Unasa stated that if Patu was attached to a dialysis machine he would've been awake during the events. Mrs.Naivila was unsure and struggled to go with her sworn affidavit , stating she thought it was a dialysis machine.

Court Proceedings adjourned and will continue today Wednesday 26th October 2022.
